a) When visiting the website
When calling up our website www.mdesign.info, the browser on your terminal device automatically sends information to our website's server. This information is stored temporarily in a "log file". The following information is collected without any action on your part and stored until it is deleted automatically:

  • IP address of accessing computer
  • Date and time of access
  • Name and URL of file called up
  • Website from which access occurs (referrer URL)
  • Browser used and, in some cases, your computer's operating system and the name of your access provider.

The aforementioned data are processed by us for the following purposes:

  • To ensure a user-friendly website design
  • To evaluate system security and stability
  • For other administrative purposes.

The legal basis for processing said data is Article 6(1) subparagraph 1 letter f of the General Data Protection Regulation (GDPR). Our justified interest results from the data collection purposes listed above. Under no circumstances will we use the collected data for the purpose of tracing them back to you.

c) When registering in our download portals/customer forums

By providing a form on our website, we make it possible for you to contact us with questions of all kinds. In this case, it is necessary to indicate the company name and address, the name of the contact person, his/her department or position, the subject and a valid e-mail address so that we know where the request comes from and are able to reply to it. Further information can be provided voluntarily.
Data processing for the purpose of making contact with us is effected in accordance with Article 6(1) subparagraph 1 letter a of the GDPR, based on your voluntary consent.
The personal data collected by us for the purpose of using the contact form will be deleted automatically once your request has been dealt with.

3. Passing-on of data
Your personal data will not be passed on to third parties for purposes other than those listed below.
We will only pass on your personal data to third parties in the event that:

  • You have expressly consented to this in accordance with Article 6(1) subparagraph 1 letter a of the General Data Protection Regulation (GDPR)
  • It is necessary to pass on said data in accordance with Article 6(1) subparagraph 1 letter f of the GDPR for the purposes of asserting, exercising or defending legal claims and if there is no reason to assume that you have an overriding interest warranting protection relating to the non-disclosure of your data
  • A legal obligation to pass on said data exists as per Article 6(1) subparagraph 1 letter c of the GDPR
  • This is legally permissible and necessary for the purposes of processing contractual relationships with you as defined under Article 6(1) subparagraph 1 letter b of the GDPR.

4. Cookies
We use cookies on our website. These are small files that are created automatically by your browser and stored on your terminal device (laptop, tablet, smartphone, etc.) when you visit our website. Cookies do not harm your terminal device in any way; they do not contain viruses, Trojans or any other kind of malware.

5. Analysis tools
The tracking measures that we use, which are outlined as follows, are implemented based on Article 6(1) subparagraph 1 letter f of the General Data Protection Regulation (GDPR). We use these tracking measures to improve the design of our website in line with user needs and to optimise it on an ongoing basis. We also use these tracking measures to collect statistical data on how our website is used and to analyse these data for the purposes of optimising the website for you. These interests can be seen as being justified as per the foregoing provision.

i) Google Analytics
For the purposes of designing and continually optimising our web pages in line with customer needs, we use Google Analytics, a web analysis service provided by Google Inc. (https://www.google.de/intl/de/about/) (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA - hereinafter referred to as "Google"). In this connection, pseudonymised usage profiles are created and cookies (see section 4) used. The information generated by the cookie about your use of this website is transferred to one of Google's servers in the USA and stored there. This information includes:

  • Operating system used
  • Referrer URL (page visited before)
  • Hostname of accessing computer (IP address)
  • Time of server request

Your IP address will not be connected with any other data held by Google. The IP addresses are masked (anonymised) so that they cannot be identified.

You have the right:

  • To request, in accordance with Art. 15 of the General Data Protection Regulation (GDPR), information on the personal data of yours being processed by us. In particular, you can request information about the processing purposes, the category of the personal data, the categories of recipients to whom your data are or have been disclosed, the planned storage period, the existence of a right to correct, delete, object to or limit processing of your data, the existence of a right of appeal, the origin of your data (insofar as these were not collected by us), about the existence of an automated decision-making process (including profiling) and any significant information regarding these;
  • To request, in accordance with Art. 16 of the GDPR, that any incorrect or incomplete personal data of yours that are stored with us be corrected without delay;
  • To request, in accordance with Art. 17 of the GDPR, that personal data of yours that are stored with us be deleted insofar as the processing of said data is not required for exercising the right to free expression of opinion and information, for fulfilling a legal requirement, on the grounds of public interest or for the purposes of asserting, exercising or defending legal claims;
  • To request, in accordance with Art. 18 of the GDPR, that the processing of your personal data be limited insofar as you dispute the correctness of the data or the processing of said data is unlawful, but you do not wish for the data to be deleted; in this case, the data are no longer required by us but are needed by you for the purposes of asserting, exercising or defending legal claims or you have objected to the processing of said data in accordance with Art. 21 of the GDPR;
  • To request, in accordance with Art. 20 of the GDPR, that your personal data provided to us be made available to you or another authorised party in a structured, standard and machine-readable format;
  • To revoke, in accordance with Art. 7(3) of the GDPR, the consent that you previously provided to us, at any time. This means that we will not be permitted to continue processing the data based on this consent in future;
  • To lodge a complaint with a supervisory authority in accordance with Art. 77 of the GDPR. For this purpose, you can generally contact the supervisory authority in your usual place of residence or work or that of our company headquarters.

7. Right of objection
Insofar as your personal data are processed based on legitimate interests as defined under Article 6(1) subparagraph 1 letter f of the General Data Protection Regulation (GDPR), you have the right - in accordance with Art. 21 of the GDPR - to object to your personal data being processed, provided that there are grounds for this pertaining to your special circumstances or that the objection is geared towards direct advertising. In the latter case, you have a general right to objection that is implemented by us without special circumstances being indicated.

8. Data security
During a website visit, we use the established SSL (Secure Socket Layer) procedure in connection with the highest encryption level supported by your browser, usually 256-bit encryption. If your browser does not support 256-bit encryption, we will use 128-bit v3 technology instead. You can see whether an individual page of our website is transmitted in encrypted form by the closed key or lock symbol on the lower status bar of your browser.
In addition, we use suitable technical and organisational security measures to protect your data from accidental or intentional manipulations, partial or complete loss, destruction or access by unauthorised third parties. Our security measures are improved on an ongoing basis in line with technological progress.

This data protection notice is currently valid and was last amended in May 2018.
It may become necessary to modify this data protection notice owing to enhancements to our website (and related offers) or to new legal or regulatory requirements.
